Accepting that a marriage has irretrievably broken down and a divorce is necessary can be one of the most difficult decisions an individual can face. Having made that commitment to each other the emotional turmoil that arises when the relationship just no longer works can be significant.
That’s why Kelly Family Law understands that a divorce is more than just a legal document. While it may be just a small part of the legal process involved in working out the division of property, parenting arrangements and financial support we treat the finalisation of each divorce with the respect it deserves.
In Australia a divorce can be granted when a marriage is said to have irretrievably broken down. This is generally proven by the parties to the marriage having been separated for at least 12 months.
While the actual divorce documentation is quite separate from a property settlement, parenting orders or spousal maintenance it is important to remember that an application for orders realting to maintenance or property settlements MUST be made within 12 months from the date of the divorce.
